RB Halter and Performance Horses, agent for the above named stallion, will herein be referred to as Breeder. This service is engaged subject to the following:
1. This contract is good for only one foal per mare. Multiple foals from the same mare in the same breeding season will require a separate contract and fee for each resulting foal. The only exception to this is twins that are carried throughout term and foaled by one mare.
2. There is a $100 booking/chute fee per mare is due with this contract. All unpaid expenses including the remaining $400 ballance of the stud fee will be payable upon receipt of an invoice, or when the mare leaves the farm, which ever is first. Mare care will be billed at $10.day dry and $12/day wet. The mare (and foal if applicable) shall be released only upon payment in full of all outstanding invoices, including those from the attending veterinarian. There will be a $40 fee for returned checks. Please make checks payable to Melanie Bearden.
3. A photo copy of the mare(s) papers will be sent to the Breeder with this contract and booking fee. A current Negative Coggins Test (within 12 months) will accompany the mare at time of drop off.
4. We require that all mares be ultra sounded before drop off at the breeding facility, and the results be provided to the Breeder at time of drop off. We prefer that your mare be in season at time of drop off to prevent any undue veterinary or mare care charges.
5. Any mare certified by attending veterinarian not to be in sound breeding condition will not be bred. Mare owner may substitute another mare during the same breeding season.
6. The breeder agrees to diligently try to settle the above named mare, and shall have sole discretion of determining the best method of breeding such mare.
7. The breeding season in force for this contract shall begin February 1 and close July 31st of the year on this contract.
8. Live Foal Guarantee: Live foal means the foal shall live for 24 hours. It is understood that if the mare proves barren, aborts her foal, or if foal is stillborn a return season is guaranteed for the following year only (Mare Owner will be responsible for all veterinary and shipping charges), providing proper notification is given. Proper notification is a written certification by a licensed veterinarian within seven days of discovery that the mare has slipped, or produced a non-viable foal. Mare owner certifies that such abortion or death did not result from any act or omission of the Owner. This guarantee is not transferable in the event of sale without the prior consent of the Breeder.
9. Third year rebreeds are subject to an additional booking fee plus any increases in the breeding fee. No live foal guarantee on third year rebreeds.
10. Should the above named stallion die, or become unfit for service, or if the above named mare should die during breeding season, then the Mare Owner may substitute another mare or breed the mare to another stallion standing at the Breeder's facility that is agreed to by both the Mare Owner and Breeder.
11. A breeders certificate will be issued to Mare Owner after all expenses have been paid in full and upon notification of birth of foal.
12. This contract is governed by the laws of the state of Texas. All accounts are due and payable in Smith County, Texas, in U.S. Dollars.
13. The Breeder guarantees a colored foal from this breeding. A colored foal is defined as one that displays enough white markings to qualify for Regular APHA Registry under their current rules and regulations. This guarantee is null and void if the Breeder is not presented with proper documentation of the foal’s registration status. This documentation must be in the form of clear pictures of foal. If the resulting foal does not qualify for Regular Registration with APHA, the Mare Owner has the option of a rebreed the following season for the cost of a $100 chute fee. All veterinary, mare care, and shipping charges will be the Mare Owner’s responsibility. This guarantee is not transferable in the event of sale without the prior consent of the Breeder. No colored foal guarantees on second year rebreeds.
14. This contract is not valid unless completed in full.
